The domain name www.ICCHA.in (hereinafter referred to as “Website”) is owned by ICCHA Stores a Partnership firm with its registered office at D.No: 8-83, Saipuram, Devaryamjal, Shameerpet Mandal, Telangana – 500 078, India (hereinafter referred to as “ICCHA”).
Your use of the Website and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, You shall be contracting with ICCHA and these terms and conditions including the policies constitute Your binding obligations, with ICCHA.

Your order for purchase constitutes your “order” which shall be subject to the terms and conditions as listed below. If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details and therefore process the order.

ICCHA.in reserves the right to terminate your membership and refuse to provide you with access to the Website if ICCHA.in discovers that you are under the age of 18 years. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement.
2 – ACCOUNT AND REGISTRATION OBLIGATIONS

3 – FEES AND SERVICES
Membership on the Website is free. ICCHA.in does not charge any fee for browsing and buying on the Website. ICCHA.in may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event, ICCHA.in reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee policies shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website.
4 – OUR PRODUCTS
All products offered by ICCHA.in are described and pictured as completely and precisely as possible and in good faith. Despite all our precautions ICCHA.in cannot be held liable for possible errors.
Regarding the colors, we have made every effort to display the “true” colors of our products that appear on the Website as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.
5 – PRICING INFORMATION
While ICCHA.in strives to provide accurate product and pricing information, pricing or typographical errors may occur. ICCHA.in cannot confirm the price of a product until you have placed the order and checked out. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, ICCHA.in shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, ICCHA.in may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and ICCHA.in will have the right to modify the price of the product and contact you for further instructions using the email address provided by you during the time of registration or cancel the order and notify you of such cancellation. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.
6 – PAYMENT PROCESS
When you order online you may pay by credit or debit card. When you provide ICCHA.in with your card information, ICCHA.in will obtain a pre-approval from the card company for the amount of the order. ICCHA.in will bill your credit card or process a transaction under your credit or debit card before your order ships. ICCHA.in accepts Visa, Maestro, Discover and Paypal Payments.
Credit or Debit cards may have daily spending limits that could delay the processing of your order substantially.ICCHA.in requires the credit or debit card security code for your card for your online purchase to protect against the unauthorized use of your credit or debit card by other persons. The security code is an individual three- or four-digit number specific to your card that may be printed on the face of your card above the embossed account number, or on the back of your card, on the signature panel (if Visa or MasterCard).
All payments made against the purchases on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
7 – CREDIT CARD DETAILS
You agree, understand and confirm that the credit card details provided by you for availing of services on ICCHA.in will be correct and accurate and you shall not use the credit card which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit card details to ICCHA.in. Further the said information will not be utilized and shared by ICCHA.in with any of the third parties unless required by law, regulation or court order. ICCHA.in will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the charge to ‘prove otherwise’ shall be exclusively on you.
8 – SECURE PAYMENT
Secure payment is one of the main concerns of ICCHA.in. That is why certified companies,such as PayU which guarantee a 100% secure transaction, have been called on to process payments.
9 – FRAUDULENT OR DECLINED TRANSACTIONS
ICCHA.in reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Website fraudulently. ICCHA.in reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these terms and conditions.
10 – TRANSPORT AND DELIVERY
Before shipping / delivering your order to you, ICCHA.in may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.
Delivery of your order: The goods purchased are delivered within the stipulated period via courier service to the delivery address that the purchaser indicates on the order. The estimated delivery period is always shown for each product. If you order several articles, the consignment will only be dispatched when all the articles are in stock. If, as a result, however, the order could not then be delivered within 30 working days, ICCHA.in will dispatch the out of stock article separately to the purchaser after this period. If stocks are exhausted or if a product cannot be delivered within 8 weeks (56 days), ICCHA.in will contact you to agree on an acceptable delivery period or to cancel the order completely free of charge. ICCHA.in cannot be held liable for damage that might ensue from a product being out of stock or from delayed delivery.
Dispatch and Transport: ICCHA.in offers a complete transport service for purchases. Renowned transport companies and courier services are used. Products can be delivered worldwide . All consignments are recorded, so you must always sign for receipt.
Loss or damage during transport: Loss and/or damage of a product that has been ordered will be borne by ICCHA.in. You are responsible for checking the goods on receipt. If any external damage is noticed, you are required to take photographs and you must send the photographs and notify ICCHA.in of possible damage by contacting us at info@ICCHA.in within 5 working days. ICCHA.in reserves the right to refuse your request if either this term is not respected or you didn’t take/send the photographs. On receipt of the notice of damage, ICCHA.in will give you instructions regarding the eventual return of the goods by you.
Delivery address: You are responsible for providing a full and correct delivery address. Incorrectly transmitted delivery addresses are your responsibility and may entail extra costs. In the event of errors in the address details of the addressee, ICCHA.in cannot under any circumstances be held liable for inability to deliver the products ordered.
Delivery Fees: Delivery fees will be at your charge and will be added separately to your invoice.
11 – CANCELLATION OF ORDER BY ICCHA.IN
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by us. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.
12 –RETURN POLICY
Definition: ‘Return’ is defined as the action of giving back the item purchased by the Buyer to the Seller on the ICCHA.in website. Following situations may arise:

• Item was defective
• Item was damaged during the Shipping
• Products was / were missing
• Wrong item was sent.
Points to be noted:
• Buyer should provide the ICCHA with a detailed description of the reasons for the return. Based on the reasons provided, ICCHA.in may accept if the return based on the following terms and conditions:
o The Buyer should inform ICCHA regarding the reasons for the return with 5 working days for the date the product has been delivered to the Buyer
o The products should be “Unused” and returned with Original packaging
o The shipment cost for returning the product shall be borne and incurred by the Buyer
• Buyer should send a copy of the invoice or delivery note and a covering letter indicating your full account number with the returned goods.
• ICCHA will refund, within 30 days of receipt by ICCHA of the returned product, any sums paid, minus the direct delivery costs (transport and order handling costs).
• ICCHA refunds carriage costs only if the purchaser did not receive the product that was ordered or if the product arrived damaged.
• ICCHA can refuse to accept or refund returned articles when the packaging has been opened or when the products have been used or damaged by you.
13 – YOU AGREE AND UNDERTAKE
• That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name oraddress or any other wrong information) any extra cost incurred by ICCHA.in for redelivery shall be claimed to you.
• That you will use the services provided by ICCHA.in for lawful purposes only and comply with all applicable laws and regulations while using the Website and transacting on the Website.
• You will provide authentic and true information in all instances where such information is requested of you. ICCHA.in reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), ICCHA.in has the right in its sole discretion to reject the registration and debar you from using the services of ICCHA.in without prior intimation whatsoever.

ICCHA.in makes no representations or warranties about the accuracy, reliability, completeness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Website or that the operation of the Website will be error free and/or uninterrupted. Consequently, ICCHA.in assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Website; and/or any interruption or errors in the operation of the Website.
Force Majeure – In the event either party is prevented in whole or in material part from performing its obligations under this User Agreement solely as a result of force majeure, upon the prompt giving of notice to the other party detailing such force majeure event and its anticipated duration, the obligations of the party so prevented shall be excused during such period of delay, and such party shall take whatever reasonable steps are necessary to relieve the effect of such cause as rapidly as possible.

18 – MODIFICATION OF USER AGREEMENT
ICCHA.in may at any time modify the User Agreement without any prior notification to you. Subsequent to any modification of the User Agreement, we will inform you of the modifications in the UserAgreement via email at the address provided by you while registering on ICCHA.in. You can access the latest version of the User Agreement at any given time on ICCHA.in. You should regularly review the User Agreement on ICCHA.in. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified User Agreement.
19 – GOVERNING LAW AND JURISDICTION
This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Telangana shall have exclusive jurisdiction in any proceedings arising out of this agreement.
Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by ICCHA.in and its decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Telangana.
Compliance with Laws:
As required by applicable law, if the Customer makes a purchase of an amount equal to or above INR 2,00,000, the Customer will be required to provide a scanned copy of his/her PAN card within 4 days of making the purchase, failing which, the purchase made by the Customer will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Customer, it need not be submitted again. The order of the Customer shall stand cancelled if there is a discrepancy between the name of the Customer and the name on the PAN Card.
Jurisdictional Issues/Sale in India Only
Unless otherwise specified, the material on the Website is presented solely for the purpose of sale in India. ICCHA make no representation that materials in the Website are appropriate or available for use in other locations/Countries other than India. Those who choose to access this site from other locations/Countries other than India do so on their own initiative and ICCHA is not responsible for supply of products/refund for the products ordered from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable.

20 – INDEMNITY
You agree to defend, indemnify and hold harmless ICCHA.in, its employees, executives, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to ICCHA.in or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, fraudulent transactions or other rights. This clause shall survive the expiry or termination of this User Agreement.
21 – TERMINATION
This User Agreement is effective unless and until terminated by either you or ICCHA.in. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Website. ICCHA.in may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website. Such termination will be without any liability to ICCHA.in. Upon any termination of the User Agreement by either you or ICCHA.in, you must promptly destroy all materials downloaded or otherwise obtained from this Website, as well as all copies of such materials, whether made under the User Agreement or otherwise. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.
22 – ENTIRE AGREEMENT
Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of ICCHA.in you agree to be bound by the Terms and Conditions.
23 – SEVERABILITY
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
24 – PRIVACY POLICY
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy . We view protection of your privacy as a very important principle. We understand clearly that you and Your Information is one of our most important assets.
